Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt. Canadian North Inc., 200, 580 Palmer Road N.E., Calgary, Alberta, T2E 7R3, from the requirements set out in subsection 602.150(1) of the CARs.
Subsection 602.150(1) states that no person shall operate a subsonic turbo-jet aeroplane that has a maximum certificated take-off weight of more than 34 000 kg (74,956 pounds) to or from an aerodrome other than Gander International Airport unless the aeroplane meets the noise emission standards set out in Chapter 3 or 4 of Volume I, Aircraft Noise, of Annex 16 to the Convention.
Purpose
The purpose of this exemption is to allow Canadian North Inc. to operate two (2) Chapter 2 gravel equipped aeroplanes.
Application
The exemption applies to Canadian North Inc. when operating two (2) Chapter 2 gravel equipped aeroplanes under the Air Operator Certificate Number 10,008. Specifically, the aircraft covered by this exemption are:
- Aircraft 552 Registration: C-GFPW Serial Number 21294
- Aircraft 562 Registration: C-GNDU Serial Number 22877
Conditions
This exemption is subject to the following conditions:
- The aircraft specified in this exemption shall serve only the communities listed in Appendix A;ÂÂ
- The aircraft shall be equipped to be suitable for operations on gravel runways; and
- A copy of this exemption shall be carried in the journey log book of each aircraft subject to this exemption.
Validity
This exemption is valid until the earliest of:
- 24:00 MDT on June 30, 2011;
- The date on which any condition specified in the exemption is not complied with; or
- The date on which the exemption is canceled in writing by the Minister, where he is of the opinion that it is no longer in the public interest or it is likely to affect aviation safety.
